Terms of service

These terms are a contract between you and Xyliase Technologies LTD, trading as BASTION ("we", "us"). They cover the Bastion bot, the dashboard and this website.

You agree to them when you add Bastion to a server, sign in to the dashboard or buy Bastion Pro. If you do not agree, please do not use Bastion.

If you add Bastion to a server, the data processing agreement also applies. It is part of these terms.

• You must be old enough to use Discord where you live. Discord requires its users to be at least 13, and older in some countries.
• To buy Bastion Pro you must be 18 or over, or have the permission of a parent or guardian who agrees to these terms for you.
• To add Bastion to a server you must own that server or have its Manage Server permission.
• You must follow Discord's own Terms of Service and Community Guidelines. Bastion is not affiliated with Discord Inc.

Bastion is a security and moderation bot for Discord servers, with a web dashboard to set it up. The free plan covers the core protection. Bastion Pro adds extra features for one server. The pricing page lists what is in each plan.

We may add, change or remove features. If we remove a Pro feature you are paying for and that matters to you, you can cancel and ask for a refund for the unused part of what you paid.

Use Bastion to protect and moderate servers you are allowed to manage. You must not:

• Use it to harass people, or to help anyone break the law or Discord's rules.
• Try to break, overload or get around the service or its limits.
• Try to reach data or servers that are not yours.
• Put other people's private information into case reasons or staff notes when it is not needed.
• Resell Bastion or pass it off as your own.

We may remove Bastion from a server, or close an account, that does any of these.

You decide how Bastion is set up in your server, and you are responsible for what your staff do with it. Bastion acts on the settings you choose, including when it acts automatically.

You are the one who decides what happens to your members' data in your server. That makes you the controller under data protection law, and us your processor. Tell your members that your server uses Bastion, for example in your rules channel, and answer them if they ask about a record. Members can run the /privacy command to learn more.

• Price. Bastion Pro costs $3.99 a month or $39 a year, in US dollars, for one server. The total, including any tax, is shown at checkout before you pay.
• Launch offer: on the monthly plan, a server that has never had Bastion Pro pays $1 a month for its first 3 months and $3.99 a month after that; the offer applies once per server and not to the yearly plan.
• Renewal. It renews automatically at the end of each month or year, at the price then shown on the pricing page, until you cancel. If we change the price, we will tell you by email at least 30 days before your next renewal.
• Cancelling. You can cancel at any time from your Billing page, in a few clicks. Cancelling takes effect at the end of the period you have paid for: Pro stays on until then, then stops, and you are not charged again. You can undo it any time before that date.
• Offers when you cancel. When you go to cancel we may offer you a free month or a one-month pause instead. Accepting is optional, and the button to cancel is on the same screen.
• Pausing. A pause starts when the period you have paid for ends. During it you are not charged and Pro is off. Billing and Pro start again by themselves on the date shown when you paused, and you can resume sooner or cancel at any time.
• When Pro ends. Pro features switch off. Your settings and records are kept.
• Voting rewards. Voting for Bastion on top.gg is optional. Every 30 counted votes earns 14 days of Pro for one server you manage. Rewards have no cash value and cannot be sold or swapped. We may change or end the scheme at any time, and votes that are automated, bought or otherwise faked forfeit any rewards and Pro time they earned.
• Removing the bot does not cancel. If you remove Bastion from a server, cancel its subscription too. You can do that from your Billing page even after the bot has gone.
• Payment. You pay on our checkout page, in a form run by Stripe, who take the payment. We never see your card number.

If you are a consumer in the UK or the EU, the law gives you 14 days from the day you buy to change your mind, for any reason.

Bastion Pro is a digital service that starts the moment you pay. Starting it straight away does not take this right from you. If you cancel within 14 days of first buying Pro for a server, we refund the whole payment.

To use this right, email support@bastionbot.xyz within the 14 days and say which server it is for. You can use your own words. We refund the same payment method within 14 days of hearing from you, and Pro switches off for that server.

The 14 days apply to your first purchase for a server. They do not start again each time a subscription renews.

Other refunds. After the 14 days, payments are not refunded for time you have already had. If something went wrong, such as being charged twice or Pro not working because of a fault on our side, email us and we will put it right, including a refund where that is fair.

Nothing here limits the rights the law gives you as a consumer. If the service is not provided with reasonable care and skill, you may be entitled to have it put right or to some or all of your money back.

We work to keep Bastion running and accurate, and we provide it with reasonable care and skill. But no security tool stops everything, and Bastion depends on Discord and on other services being available.

We do not promise that Bastion will prevent every attack, catch every harmful message, never act on the wrong person, or always be online. Keep your own safeguards too, such as two-factor sign-in for your staff and careful role permissions.

What we never limit. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow us to limit. If you are a consumer, nothing in these terms takes away your statutory rights.

If you are a consumer. If we fail to keep to these terms, we are responsible for loss or damage you suffer that was a foreseeable result of that failure. We are not responsible for loss that was not foreseeable, or for business losses, because Bastion is supplied to you for personal use. If digital content or a service we supply damages a device or other digital content of yours because we did not use reasonable care and skill, we will repair the damage or pay compensation.

If you use Bastion for a business. We are not liable for loss of profit, revenue, business, goodwill or data, or for indirect or consequential loss. Our total liability to you in any 12 months is limited to the greater of the amount you paid us in those 12 months and 100 pounds sterling.

We are not responsible for failures caused by things outside our reasonable control, such as a Discord outage.

• You can stop at any time. Remove Bastion from your servers, cancel any subscription, and delete your account from the account page.
• We can suspend or end your use of Bastion if you seriously or repeatedly break these terms, or if we have to by law. Where we reasonably can, we will tell you first and give you the chance to put things right.
• If we end a paid subscription and you have not broken these terms, we refund the unused part of what you paid.
• If we stop offering Bastion altogether, we will give at least 30 days' notice on this website and refund the unused part of any paid subscription.

We may update these terms. When we do, we change the date at the top. If a change is important and you have a paid subscription, we will tell you by email at least 30 days before it takes effect. If you do not accept the change, you can cancel before then and we refund the unused part of what you paid.

These terms are governed by the law of Scotland.

If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts of that country or in the courts of Scotland. If you live in England, Wales or Northern Ireland, you can also use your local courts.

If you use Bastion for a business, the courts of Scotland have exclusive jurisdiction.

Please email us first. Most problems can be sorted out without a court.
